J.R. Smith — The Bourbon-Infused Mentalist

These Terms & Conditions (“Terms”) govern bookings with J.R. Smith (“Performer”). By paying a deposit, signing an agreement, or confirming in writing, the Client accepts these Terms.

1) Hold, Deposit & Confirmation

• Soft Hold: Courtesy holds may be offered but are not guaranteed. Dates remain open until deposit is received.
• Deposit / Retainer: A mandatory 20% non-refundable retainer is required to confirm and reserve the booking. It is applied to the total fee and compensates for turning away other work.
• Confirmation: Booking is confirmed upon written acceptance and cleared deposit. Availability can change rapidly—first confirmed, first served.

2) Payment, Balance & Fees

• Balance Due: For corporate/weddings, balance is due 7 days prior to performance. For bars/lounges, balance is due at call time unless otherwise stated on the invoice.
• Methods: Accepted methods appear on your invoice (card, ACH, bank transfer, PayPal, etc.). Processing fees may apply.
• Late Payment: Overdue balances may incur a 1.5% monthly late fee (or the maximum permitted by law).
• Chargebacks: Unauthorized chargebacks are Client’s responsibility and may include administrative and collection costs.
• Overtime / Extensions: If requested on site and available, time is billed in 30-minute increments at the quoted rate.

3) Reschedule & Cancellation

• Client Reschedule: With 14+ days’ notice, the deposit may transfer once to a new mutually available date within 12 months.
• Client Cancellation: The 20% deposit is non-refundable. Cancellations within 7 days of the event owe 100% of the remaining balance.
• Performer Cancellation: If an emergency prevents performance, all monies paid are refunded and a suitable substitute will be offered where possible.

4) Timeline, Delays & Show Flow

• Call Time: Client provides an accurate schedule and on-site contact. Minor shifts (±15 min) are accommodated when possible.
• Client-caused Delays: Significant delays may shorten performance without refund or, if extended, incur overtime.
• Set Length: Cocktail/roaming sets are typically 45–60 minutes; stage segments vary by program.

5) Travel, Parking & Lodging

• Local: Client provides or reimburses venue parking/valet and any required load-in access.
• Non-Local: For events outside Las Vegas metro, reasonable travel (flights/mileage), lodging, and per diem may apply and will be quoted in advance.

6) Technical & Hospitality Rider

• Audio/Lighting: For 75+ guests, a microphone/PA is recommended. Basic lighting must allow guests to see faces and props.
• Stage/Area: For stage, minimum 6’×8’ performance area with clear sightlines. One small table and nearby power when needed.
• Backstage: Secure prep space/dressing room preferred. Still water provided.

7) Safety, Content & Participation

• Consent: Participation is voluntary and respectful. Any guest may opt out at any time.
• Props: Any routine that appears “dangerous” is performed only with venue approval and safety controls. No live flames or weapons unless explicitly approved by the venue.
• Minors: Family-friendly material is available upon request. Guardian consent required for youth participation.
• Bar-Style Banter: Material can be tuned to brand guidelines: spicy or mild, never cheesy, never discriminatory.

8) Media, Recording & Publicity

• Casual guest photos/videos are welcome. Professional filming or broadcast requires written permission in advance.
• Unless the Client opts out in writing before the event, Performer may capture limited behind-the-scenes content for promotional use.
• Client may post captured media for recap/socials. Commercial/paid usage requires written approval.
• NDA needs? Happy to sign a reasonable confidentiality agreement when provided before the event.

9) SMS/Email Communications

10) Liability, Substitution & Force Majeure

• Liability Cap: Except where prohibited by law, Performer’s total liability is limited to amounts paid by Client.
• Substitution: In rare cases of illness/emergency, an equivalent professional may be provided or fees refunded.
• Force Majeure: Neither party is liable for failure/delay due to events beyond reasonable control (e.g., severe weather, power loss, venue issues).

11) Governing Law

These Terms are governed by the laws of the State of Nevada. Venue for disputes is Clark County, NV.

Acceptance

Payment of the deposit, written confirmation, or a signed agreement indicates acceptance of these Terms. Any negotiated changes must be in writing.
